Children’s Observatory: a view towards educational policy for adolescents

The organization’s mission is to defend the rights and interests of children and adolescents through socio-legal protection mechanisms, in a democratic and participatory manner, thus contributing to building a culture that incorporates the conception of children and adolescents as subjects of rights.
The transition from the 80s to the 90s was marked by the increase in violence against children and adolescents in Maranhão. The need to create a specific service, with the character of legal advice, which would cope with frequent violations of children and adolescents rights, was identified then. Thus, in August 1991, CDMP was established, with the support of other organizations, having the following priorities: confrontation of sexual violence; combating the exploitation of child labor, mainly domestic work; combating physical violence; training of people to compose the rights and tutelary councils; studies and research on violence; monitoring of the levels of offences; and combating institutional violence in that field. Currently, the priority is the right to education.
Project
The project will assess the educational plan offered to adolescents in fulfillment of socio-educational measures – male and female liberty deprivation and provisional detention – in the city of São Luís. Additionally, it will foster the implementation of targeted and specific actions, which consider the peculiarity of that audience and enable greater and better school performance, with the consequent prospect of better life conditions.
Context
Over the past 20 years, Brazil has improved a lot in the legislative and normative spheres, with, for instance, the adoption of the Convention on the Rights of the Child and the creation of the Statute for Children and Adolescents. However, there has not been enough institutional reorganization for the attention to their fundamental rights (education, health, social assistance, security, culture, entertainment…) to be properly ensured in daily life, particularly of adolescents involved in offences.
The Statute provides, in Article 112, the following measures for adolescents involved in offences: remission; warning; obligation to repair the damage; community services; probation; semi-liberty and, exceptionally, detention.
With regard to liberty deprivation measures, the Statute provides that the institution responsible for the deprivation of liberty shall have an educational character. Nevertheless, in Maranhão the educational rights of those adolescents are not yet being realized.
